Judicial Panel to Reexamine Decision That Permitted Trump to Deploy Military Forces to Portland

The federal appeals court has maintained a prohibition on sending national guard in Portland, Oregon, following a recent legal decision.

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on this week that it would rehear the case concerning the president’s authority with an larger panel of eleven justices. The judicial body also vacated a previous ruling from a three-judge panel that had sided with the federal government.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent development in a protracted court case over whether the administration has the legal right and valid reason to send national guard forces in Portland. Approximately two hundred troops have been in limbo since late September when the deployment effort was started in due to months of protests.

Conflicting Arguments

The federal government has claimed that government employees at the ICE facility in the southern part of the city were under attack, while local authorities maintain that municipal police have control of the circumstances.

In defiance of descriptions of the city as “war ravaged”, residents have been sharing footage of lush hiking trails and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in Portland enacted two temporary restraining orders this period – one preventing the federalization of the Oregon national guard, and another prohibiting the use of any military personnel in the state, after attempts to circumvent the first order by calling up out-of-state forces.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing control of state troops – but the subsequent injunction stayed effective, blocking the actual deployment of the forces.

Full Panel Consideration

The Tuesday decision means the issue will be heard by the full court – with all decisions under review simultaneously – by a panel of 11 judges.

“This ruling demonstrates that facts are important and that the courts are working to ensure government responsibility. The constitution limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot send the military into American urban areas without cause. We will continue protecting Oregon’s laws, values, and sovereignty as this legal proceeding moves forward and our fight continues in the courts.”
